 結婚前の旧姓で仕事ができないのは人格権の侵害だとして、勤務先の中高一貫校を運営する学校法人を訴えた女性教諭の裁判で、控訴審が26日に東京高裁で始まる。一審は「戸籍名のほうが個人を識別できる」などとして、女性の請求を退けた。今も生徒から旧姓で呼ばれている女性は「生きるとはどういうことかを生徒にも考えてほしい」と語る。

 女性は2003年から東京都町田市の私立「日本大学第三中学・高校」に勤務。13年に結婚して改姓した後も、旧姓の使用を学校に要望したが認められなかった。生徒や保護者からは旧姓で呼ばれる一方、時間割表や保護者への通知などは戸籍名が使われている。
 だが、昨年10月の東京地裁判決は、職場で職員を特定するような場面では戸籍上の姓の使用を求めても違法でないと結論づけた。
 女性は教員免許は旧姓のままで、結婚前に書いた参考書などもある。旧姓で築いた業績と名前を切り離したくないという。「呼称は個人の自由だと思う。生徒たちにも社会でおかしいと思うことを主張できる人になってもらいたい。最後まであきらめない」と話す。
 ログイン前の続きこの判決は、インターネット上でも反響を呼んだ。中でも多かったのが15年12月の最高裁大法廷の判決との矛盾を指摘する声だ。
 民法が夫婦同姓を強制しているのは憲法違反だと訴えた裁判で最高裁は、結婚で改姓する妻のアイデンティティーの喪失感は「旧姓の通称使用により一定程度は緩和できる」と述べた。
 この裁判の原告だった大学教員吉井さんは「結局、別姓での結婚も旧姓使用もダメなら、どうしたらいいのでしょうか」と嘆く。「どちらの裁判も、裁判官の個人的な家族観が反映されているのでは」

 吉井さんも結婚直後に非常勤講師を務めた短大で旧姓使用を求めた際、「雇い主次第」という不安定さに直面したという。「女性の活躍をいうなら早く夫婦別姓を認めてほしい」。今年こそ国会での議論が進むことを期待している。
